Azerbaijan: Journalist sends two complaints to ECHR

IRFS, Baku, 15 Sep 2008 – Today, September 15, two complaints in connection with journalist Rovshan Hajiyev’s court battles with Public TV were sent by the Legal Education Society to the European Court of Human Rights. Legal Education Society representative Nurlana Aliyeva told this to the Institute for Reporters’ Freedom and Safety.

Recall that the one lawsuit originally filed by Hajiyev against Public TV related to defense of honor and dignity and the other stems from an incomplete information request.

On 28 August 2006, the book “Public TV in the Press Mirror” was presented. Hajiyev was the editor of this book and compiled all of the articles included there. Representatives of Public TV present during the presentation disrupted the event and demanded that Hajiyev refute the information in the book and apologize to the TV channel. On the same day in the evening, Hajiyev claims that remarks insulting and damaging to his honor and dignity were made on “Jarchi” news program.

In connection with this, on 25 September 2006, Hajiyev appealed to the Yasamal District Court, seeking to receive an apology from Public TV, the broadcasting of a refutation on “Jarchi” and 50,000 in compensation for the damages that the journalists claims this program resulted in. Neither the Yasamal District nor Azerbaijan’s appellate nor Supreme Court fulfilled this lawsuit.

Regarding the information request that was not appropriately responded to, Hajiyev’s lawsuit was rejected by all court instances within Azerbaijan.

In both of the lawsuit that Hajiyev has sent to the European Court of Human Rights, it is alleged that Article 6, 10, 13, and 14 of the European Convention on Human Rights have been violated.
